Eligibility & Capacity

By using the Website you represent and warrant that:

• You are at least 20 years old (the age of majority under Thai law) or are using the Website under the express supervision and consent of a parent or legal guardian who accepts these Terms on your behalf.
• You have the legal capacity to enter into a binding contract.
• You are not on any sanctions list and are not located in any jurisdiction where access to the Website is prohibited.
• You will use the Website for personal, non-commercial purposes only, unless we have given you prior written consent to resell our products. Curvf may verify your age, identity, or eligibility at any time and refuse service if verification fails.

Your Account

Account responsibility and Curvf's enforcement rights:

• You are responsible for maintaining the confidentiality of your account credentials, including any password and any third-party login (e.g., Google) linked to your account.
• All activity that occurs under your account is deemed to be your activity, and you accept full responsibility for it.
• You must notify Curvf immediately of any unauthorized access or suspected breach. Curvf is not liable for any loss arising from your failure to safeguard your credentials.
• Curvf may suspend, restrict, or terminate your account at any time, with or without notice, if Curvf reasonably believes you have breached these Terms, engaged in fraudulent activity, abused promotions, or initiated chargebacks contrary to the Refund Policy.

Product Information, Pricing & Typographical Error Protection

Curvf makes commercially reasonable efforts to display product information, colors, sizes, materials, and prices accurately. Minor variations in color or texture due to monitor calibration, lighting, or production batch are not defects.

• All prices are listed in Thai Baht (THB) and are inclusive of VAT where applicable. Shipping fees are calculated at checkout.
• All prices, promotions, and product availability are subject to change without prior notice.
• Typographical / Pricing Error Clause: If a product is listed at an incorrect price, with incorrect descriptive information, or with incorrect stock status due to a typographical, system, exchange-rate, or third-party data-feed error, Curvf reserves the absolute right to cancel any affected order, whether or not the order has been confirmed and payment has been processed.
• In such cases, Curvf's sole obligation is to refund any amount actually paid by you to the original payment method, with no further liability of any kind, including for any incidental damages, lost opportunity, or claim of expectation.

Order Acceptance & Contract Formation

This clause is critical: please read it carefully.

• Your order constitutes an offer to purchase the products listed, subject to these Terms.
• An order confirmation email is an acknowledgement of receipt only — it is NOT acceptance of your order.
• A binding contract of sale is formed only when Curvf dispatches the goods to the carrier and sends you a shipping confirmation email containing a tracking number. Until that moment, Curvf may refuse, cancel, or amend the order for any reason in its sole discretion, including but not limited to: stock unavailability, pricing or product errors, suspected fraud, abuse of promotions, prior chargeback history, or violation of these Terms.
• Curvf may also limit the quantity of any item per customer, household, or address, and may refuse or cancel orders that appear to be placed by dealers, resellers, distributors, or automated systems.

Payment

Payment is due in full at the time of order placement.

• Curvf accepts the payment methods displayed at checkout. All payments are processed by third-party payment service providers, and your use of their services is subject to their respective terms and privacy notices.
• You represent that you are the lawful holder of the payment method used and have full authority to use it.
• Curvf may verify payment legitimacy before shipping.
• Any failed, reversed, or fraudulent payment immediately voids the order and may result in account suspension and reporting to relevant authorities.

Promotions, Coupons & Anti-Abuse

All discount codes, promotions, gift vouchers, and store credit are non-transferable, non-resellable, and have no cash value. They are valid for the period stated and may be revoked at any time without prior notice. Unless explicitly stated, promotions cannot be combined or stacked. Curvf reserves the right to cancel orders, void coupons, and close accounts that Curvf reasonably believes are engaged in any of the following — Curvf's determination of abuse is final:

• Coupon stacking or systematic exploitation of pricing errors.
• Account multiplication to circumvent per-customer limits.
• Repeated buy-and-return cycles ("wardrobing").
• Chargeback abuse or any pattern of fraudulent claims.

Shipping, Delivery & Risk of Loss

Estimated delivery dates and timeframes are estimates only and are not guaranteed. Time is not of the essence in any Curvf contract of sale.

• Risk of loss and title pass to you at the point the carrier accepts the package from Curvf. From that moment, the parcel is in the carrier's custody and any loss, theft, damage, or delay is governed by the carrier's terms — not by Curvf.
• Curvf is not liable for any delay or non-delivery caused by: third-party couriers, customs, postal strikes, severe weather, acts of God, civil disturbance, government action, or any other event of Force Majeure (see Section 15).
• You are responsible for providing a complete and accurate delivery address.
• The consequences of incorrect addresses are governed by Section 5 of the Refund & Return Policy.

Returns, Refunds & Cancellations

All returns, refunds, exchanges, and cancellations are governed exclusively by the Refund & Return Policy, which is incorporated into these Terms by reference. By placing an order, you accept the Refund & Return Policy in full.

Intellectual Property

All content on the Website — including text, graphics, logos, icons, product imagery, photography, product descriptions, software, and the underlying source code — is the exclusive property of Curvf or its licensors and is protected by Thai and international copyright, trademark, and intellectual-property laws.

• You are granted a limited, revocable, non-exclusive, non-transferable license to view and use the Website solely for the purpose of personal, lawful shopping.
• You may not copy, reproduce, modify, distribute, scrape, mirror, frame, republish, or create derivative works from any part of the Website without Curvf's prior written consent.
• Unauthorized use will be pursued to the fullest extent of the law.

Prohibited Use & User Conduct

You agree NOT to engage in any of the following. Violation may result in immediate account termination, order cancellation, and referral to law enforcement:

• Use the Website for any unlawful purpose or in violation of these Terms.
• Use any automated system, bot, crawler, scraper, or data-mining tool to access the Website or harvest content, pricing, or user data.
• Attempt to gain unauthorized access to the Website, Curvf's systems, or other users' accounts.
• Upload viruses, malware, or any code designed to disrupt the Website's operation.
• Post, transmit, or submit any content that is unlawful, defamatory, infringing, obscene, harassing, or that violates a third party's rights.
• Misrepresent your identity or impersonate any person, including Curvf staff.
• Interfere with or disrupt the Website's security features, rate limits, or fraud-prevention systems.

Privacy & Personal Data Protection (PDPA)

Your use of the Website and your purchases are subject to the Curvf Privacy Policy, which describes how Curvf collects, uses, stores, and discloses personal data in compliance with the Personal Data Protection Act B.E. 2562 (PDPA). By using the Website, you consent to the data processing practices described in the Privacy Policy.

Disclaimer of Warranties

To the maximum extent permitted by Thai law, the Website and all products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or freedom from errors. Curvf does not warrant that the Website will be secure, error-free, or available at any specific time. Statutory consumer rights that cannot be excluded under Thai law are not affected.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Curvf, its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings, even if advised of the possibility of such damages.
• Curvf's total aggregate liability to you arising out of or in connection with any product, order, or use of the Website — whether in contract, tort, statute, or otherwise — shall not exceed the actual amount you paid to Curvf for the specific order giving rise to the claim.
• These limitations apply regardless of the legal theory on which the claim is based and survive termination of these Terms.

Indemnification

You agree to indemnify, defend, and hold harmless Curvf, its directors, officers, employees, affiliates, contractors, and agents from and against any and all claims, demands, liabilities, damages, judgments, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your breach of these Terms or any policy incorporated by reference.
• Your misuse of the Website or any product.
• Your violation of any law, regulation, or third-party right.
• Any content you submit to the Website.

Force Majeure

Curvf shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, civil unrest, government action, embargo, strike, labor dispute, courier failure, internet or telecommunications outage, power failure, cyberattack, or supply-chain disruption ("Force Majeure"). Curvf's obligations are suspended for the duration of the event, and Curvf may cancel affected orders with a refund as its sole remedy to you.

Modification of Terms

Curvf may revise these Terms at any time by posting an updated version on the Website with a new "Last Updated" date. Material changes will be communicated by email or through a notice on the Website where reasonably practicable. Your continued use of the Website or placement of an order after the effective date constitutes binding acceptance of the revised Terms. If you do not agree, you must stop using the Website.

General Provisions

The following general provisions apply throughout these Terms:

• Entire Agreement. These Terms, together with the Privacy Policy and Refund & Return Policy, constitute the entire agreement between you and Curvf and supersede all prior communications, proposals, and representations.
• Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
• No Waiver. Curvf's failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign these Terms. Curvf may assign them freely as part of a corporate restructuring, merger, or asset sale.
• Notices. Curvf may deliver notices to you via the email associated with your account or by posting on the Website. Notices to Curvf must be sent to the contact email below.

Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict-of-laws rules. The courts of Thailand shall have exclusive jurisdiction. The parties agree that the Thai-language version of these Terms shall prevail in the event of any inconsistency between the English and Thai texts.
